Terms of Service

Version 1.0, effective 2026-05-18.

These terms govern your use of Modulate ("we", "us"). By creating an account you agree to them.

The service

Modulate is in closed beta, by invitation. We may add, change, or remove features at any time and provide the service on an "as is" basis without uptime commitments.

Your account

You must be at least thirteen years old. You are responsible for your account's security and for any activity under it.

Acceptable use

You may not use Modulate for:

  • Illegal content or content that infringes intellectual-property rights you do not hold.
  • Child sexual abuse material. We report this to law enforcement immediately.
  • Sexual or violent content of identifiable people without their consent.
  • Spam, phishing, or malware.
  • Bypassing security, reverse-engineering the service, generating excessive load, or reselling access.

Your content

You retain ownership of what you upload and create. You grant us a non-exclusive, royalty-free, worldwide licence to host and display your content strictly to operate the service for you. The licence ends when you delete the content or your account.

We do not use your content to train AI models. We do not share it outside your account except where required to operate a feature you explicitly invoke.

Suspension and termination

We may suspend or terminate your account for violating these terms, where required by law, or where continued service poses a risk. We give notice where practical; for abuse or security incidents we may act without notice. You can delete your account from Settings at any time.

Beta caveats

  • Features, quotas, and pricing may change with notice.
  • We may end the beta entirely; we will give you a reasonable window to export your work.
  • Back up important work elsewhere.

Warranty disclaimer

The service is provided "as is", without warranty of any kind, express or implied.

Limitation of liability

To the maximum extent permitted by law, Modulate is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunities arising from your use of the service.

Governing law

These terms are governed by the laws of New South Wales, Australia. Any dispute will be resolved in the courts of New South Wales.

Changes

We post material changes here and bump the version date. Continued use after a change means you accept the updated terms.
